(a) It shall be unlawful for any person to own a dog or to transport a dog to St. Paul Island. This provision shall not apply to seeing-eye dogs.

(b) It shall be unlawful for any person in any way to disturb or interfere with a seal rookery.

(c) Any person harboring domesticated animals shall keep such animals confined either by tether or by pen on his own premises. Domesticated animals shall include ducks, geese, chickens, goats, hamsters, gerbils, rabbits and all other animals brought under man’s control, but shall not include cats.

(d) Any person harboring domesticated animals shall maintain a clean and sanitary yard or pen and provide proper food, water and care.

(e) No person shall, without permission of the owner, release any animal restrained as defined in subsection (c) of this section.

(f) Any person harboring a vicious animal which, when unprovoked, has bitten or attacked a human being shall confine that animal within a building or secure enclosure and shall not take such animal out of such confinement unless such animal is muzzled or otherwise secured.

(g) All animals impounded as vicious animals shall not be redeemed, but shall be destroyed in a humane manner within 24 hours; except that no such animal shall be destroyed without the owner’s consent except upon a judicial determination that the animal is vicious.

(h) No person may harbor an animal that is in any way showing symptoms of infectious or contagious disease.

(i) Any police officer may, when a domesticated animal is found running at large or otherwise in violation of any provision of this chapter, issue a citation or summons and complaint to the owner of said animal, and will be responsible for securing the animal and posting any fines ascribed by the Court, or upon entering a plea of not guilty, be entitled to trial as authorized by law.

(j) Any person in violation of this section is, upon conviction, guilty of a City offense and is punishable as set forth in CCO 9.05.020. [Ord. 82-10, 1982. Code 1979 § 8.9.]
