Unless otherwise provided for, all violations of the City Code of Ordinances shall be classified relative to the seriousness of the offense, or offenses, as set forth below:

(a) Level I Offense. A Level I offense is punishable by a mandatory fine of $300.00. Upon the written citation of said Level I offense, and after 48 hours from the written notification of, or citation of, said offense, each day of the continuance of said offense is considered to be a new offense.

(b) Level II Offense. A Level II offense is punishable by a mandatory fine of $100.00 for a first violation. A second conviction of a Level II offense within a period of two years will be punishable by a mandatory fine of $200.00. A third conviction of a Level II offense within a period of three years will be punishable by a mandatory fine of $300.00.

(c) Level III Offense. A Level III offense is punishable by a mandatory fine of $50.00 for the first violation. A second conviction of a Level III offense within a period of one year will be punishable by a mandatory fine of $100.00. Each following conviction for a Level III offense, during the following five years, shall result in mandatory fines increasing in increments of $50.00 up to the maximum of $300.00.

(d) Unclassified Offense. A violation of any section of the City Code of Ordinances that has not been specifically classified is a Level III offense and shall be punishable according to subsection (c) of this section.

(e) Unless otherwise provided for within this chapter, or by State statute adopted within this chapter, a mandatory fine must be assessed and may not be suspended. Community work service may be utilized in lieu of mandatory fines wherein the defendant is able to show his inability to pay. Community work service must be completed within three months of the offense being adjudicated, and may not be undertaken except as assigned by the Saint Paul Department of Public Safety. Community work service shall not directly or indirectly benefit or promote activities connected with gambling or the sale of alcohol, nor shall it benefit any privately held for-profit company or corporation. The Director of Public Safety shall promulgate rules for the operation of a community work service program, and shall determine what work service is appropriate for the benefit of the entire community of Saint Paul. The community service worker shall agree and attest to said rules by signature. Failure to follow said rules shall not result in credit for completion of said work service. [Code 1979 § 8.02.]
