(a) It is unlawful for the parent or legal guardian to negligently allow a minor child on a public street, public way, or any public place in the City during the prohibited hours described in this section unless the minor is accompanied by the parent, legal guardian or an adult person charged with the control of the minor.

(b) The presence of a minor on a public street or way as described above shall be primary evidence of the guilt of the parent or legal guardian having custody or control of the minor of violating subsection (a) of this section.

(c) It is unlawful for any minor age 12 or under to be on the public streets, public way, or any public place in the City between the hours of 9:00 p.m. and 7:00 a.m. on Sunday through Thursday and from 10:00 p.m. to 7:00 a.m. on Friday and Saturday.

(d) It is unlawful for any minor age 13 through 17 to be on the public streets, public way, or any public place in the City between the hours of 10:00 p.m. and 7:00 a.m. on Sunday through Thursday and from midnight to 7:00 a.m. on Friday and Saturday.

(e) During any declared school holiday, special occasion or vacations, the curfew established for Friday and Saturday shall apply except that Sunday curfew hours shall be in effect the last day of such vacation immediately prior to the next school day.

(f) The curfew hours established by this section may be extended by two hours to permit minors to attend or participate in school, group-sponsored or community activities or to permit individual minors who have evening employment to remain at their places of employment for not more than one hour after the usual curfew.

(g) Curfew hours established by this section shall not be enforced if the minors are subsistence hunting.

(h) Failure to comply with any of the above requirements is a City offense and is punishable as set forth in CCO 9.05.020. [Ord. 91-03, 1990. Code 1979 § 8.16.]
