A. OVERVIEW

1. This section of the City of Saint Paul (City) Personnel Policy and Procedure Manual (Manual) describes: the purpose of the manual; its application to City employees’ relevance to legal requirements to the manual; general responsibilities of policy makers, City employees, and management; and the role of the personnel committee.

B. POLICY AND PROCEDURE

1. Purpose

a. The City of Saint Paul Personnel Policy and Procedure Manual has been developed to provide the policy, procedure, and operational guidelines for equitable and effective management of the City’s most valuable resource; its personnel.

2. Application

a. The personnel policies and procedures contained herein shall apply to all employees of the City unless specifically excluded in these or other provision of the City Code of Ordinances (CCO).

3. Relevance to Legal Requirements

a. This manual is not intended to duplicate or conflict with any legal requirements placed upon the City. State and Federal legal mandates will supersede this manual always.

4. Severability

a. As provided CCO 1.05.070, Severability or Ordinance Provisions, if any portion of this manual is subsequently found to be invalid, such invalidity shall not affect the other parts of this Manual.

5. Interpretation

a. Any ambiguous terms, clauses, or situations that may be unclear should be addressed to the City Manager. A legal opinion may be obtained from the City attorney if authorized by the City Manager. All legal opinions related to this Manual will be kept on file with the City Clerk.

6. Responsibilities and Authority

a. The general roles and responsibilities for personnel activities are defined below:

i. The City Council shall review substantive changes to personnel policies when made and shall give guidance to the City Manager regarding any other or additional policy set by the Council for City employees.

ii. The City Manager with ultimately be responsible for the ensuring that City policies are implemented consistent with City Council direction and will review all personnel actions. The City Manager will keep the City Council informed as to requirements for revising the personnel policies. The City Manager may delegate responsibilities for personnel transactions to the Human Resources Manager and/or City Clerk or individual department directors in the following areas:

a) Recruitment and Selection;

b) Employee Performance Evaluations;

c) Individual Development Plans;

d) Performance Improvement Plans;

e) Merit Increases;

f) Disciplinary Actions, however all separations/terminations/dismissals shall be reviewed by the City attorney and Personnel Committee and approved by the City Manager, unless otherwise stated in CCO, this Manual, or Employment Contract.

iii. The City Manager shall serve as the Personnel Officer for the City and shall be responsible for developing the procedures to implement the personnel directives and for administering the day-to-day personnel program and associated activities. The City Manager may delegate part or all of these duties to the City Clerk or Human Resources Manager. The Personnel Officer will also serve as the designated Affirmative Action Officer and American with Disabilities Act Compliance Officer for the City and will be designated as the contact for any complaints, or questions regarding the City Personnel Policy Numbers 02.05 – Anti-Discrimination, 02.08 - Americans with Disabilities Act (ADA) Compliance, and 05.14 – Anti-Harassment.

iv. Each employee is responsible for reading, understanding and complying with the provisions of this Manual.
