A. OVERVIEW

1. Description and Purpose The following policy describes the regular work schedule for employees of the City of Saint Paul (City).

2. Applicability This policy applies to all employees of the City.

3. Failure to Comply Failure to comply with this policy may result in disciplinary action in accordance with any and all disciplinary policies of the City.

B. POLICY AND PROCEDURE

1. Working Hours

a. The City Manager shall ensure that appropriate arrangements for working hours in the different job categories in the City are in compliance with the Fair Labor Standards Act (FLSA).

2. Work Day and Work Week

a. The regular work day shall consist of eight (8) hours, excluding one hour unpaid for lunch, from 8:00 a.m. to 5:00 p.m. Staffing needs and operational demands may necessitate variations in starting and ending times, as well as variations in the total hours that may be scheduled each day. Any variation from this policy must be approved in writing, in advance, by the City Manager or delegated supervisor.

b. The normal work week schedule shall consist of five (5) regular work day, or forty (40) hours. The employee’s immediate supervisor via a work schedule change may grant exceptions to the normal work week schedule for individual employees. Staffing needs and operational demands may necessitate variations in starting and ending times, as well as variations in the total hours that may be scheduled each week.

c. The employee is responsible for notifying immediate supervisor by telephone or email, if the employee is reporting to work later than their approved start time.

d. See City Personnel Policy Number 05.05 - Attendance and Punctuality for addressing absences and tardiness by employees.

e. The City Manager and/or Department Directors may designate alternative work schedules for employees whose job responsibilities may be more appropriately performed at alternative work periods.

f. The City Manager and/or Department Directors may schedule a shorter work day and/or work week if monetary constraints or work load dictates.

g. The Department of Public Safety may have alternative work shifts in compliance with FLSA.

3. Meal Period and Breaks

a. The City is not required by state law to provide meal periods or breaks; however, the City recognizes that providing breaks may increase productivity and moral.

b. Employees working a regular work schedule of six (6) to eight (8) hours a day may take a one (1) hour unpaid lunch, which is usually taken from 12:00 p.m. to 1:00 p.m. Employees working less than six (6) hours a day will not be provided a lunch break.

c. Employees working a regular work schedule of more than seven (7) hours a day will be provided two (2) fifteen (15) minute breaks, one (1) fifteen (15) minute break in the morning, which is usually taken between 10:00 a.m. and 10:15 a.m., and one (1) fifteen (15) minute break in the afternoon, which is usually taken between 3:00 p.m. and 3:15 p.m.

d. Employees working six (6) or less hours a day will be provided one (1) fifteen (15) minute break.

e. Staffing needs and operational demands may necessitate variations in start and end times of breaks. Variations in break times will be determined by the employee’s immediate supervisor and communicated to the employee.
