(a) Areas designated for open mooring shall be open to all members of the public. Such areas shall be used primarily for temporary mooring. Open mooring spaces shall be utilized on a “first-come-first-served” basis. No boat or boat owner shall have any exclusive right to open mooring space. Should any boat mooring at open moorage leave such space for any purpose, it shall have no exclusive right to return to the same space if, upon return, it is found that the space is occupied by another boat.

(b) Every boat owner using the open mooring facilities shall be charged a mooring facility use fee. [Code 1979 § 18.08.040.]
