If any section, paragraph or provision of this chapter is challenged, and a court of competent jurisdiction invalidates or grants an injunction against the enforcement of such section, paragraph or provision, then the remaining sections, paragraphs and provisions shall remain in full force and effect as though the invalid or enjoined section, paragraph or provision were not a part hereof. In the event a court of competent jurisdiction finds the challenged section, paragraph or provision to be valid, then the City shall collect any back sales taxes, including interest and penalties, imposed under the challenged section, paragraph or provision.
