14.15.020 Reckless operations – Penalties.
(a) It is unlawful for any boat owner using the boat harbor to operate or cause to be operated a boat in a reckless manner. For the purpose of this section, “to operate in a reckless manner” means to operate a boat in willful or wanton disregard of the rights or safety of others, or without due caution and circumspection, or at a speed or in a manner as to endanger or to be likely to endanger a person or property, or that which creates a substantial and unjustifiable risk of harm to person or property. A substantial and unjustifiable risk is a risk of such a nature and degree that the conscious disregard of it or a failure to perceive it constitutes a gross deviation from the standard of conduct that a reasonable person would observe in a situation.
(b) A person convicted of “reckless operation” within the Saint Paul harbor facility is guilty of a misdemeanor and may be fined not more than $1,000, together with the costs of prosecution thereof, or by imprisonment for not more than one year, or by both such fine and imprisonment; in addition thereto, his privilege of using the boat harbor facilities may be suspended for not more than one year.
