(a) Any sighting of a rodent or rodent indicia shall create a rebuttable presumption of a rodent infestation, which shall be reported to the municipality within two hours. Reports shall be made to Public Safety.

(b) Upon notification of infestation, the City Manager or designee is authorized to take any measure reasonably related to containing the infestation and eradicating the rodent(s) including, but not limited to, requiring the cessation of any use or occupancy of the real property or vessel or isolating the structure. All costs of such containment shall be borne by the owner of the structure.

(c) The City Manager shall cause written notice of such action to be delivered to any owner or occupant, or by posting on the real property or vessel. The owner, occupant, or other interested person may, within 24 hours of receipt of said notice, request a hearing by the City Manager or designee to contest the action taken or rebut the presumption of an infestation. Such hearing shall be held within 48 hours of request. The contesting party bears the burden of demonstrating the absence of rodents. [Ord. 21-03 § 2 (Att.), 2021.]
