(a) Any person who fails to obtain a permit at least 24 hours prior to the use shall be fined an amount equal to up to three times the permit fee; provided, however, that the City Manager may waive such fine for good cause shown.

(b) A person who fails to comply with a condition imposed in the permit or otherwise violates a provision of this article shall be subject to a fine of up to five times the permit cost for each violation. In addition, each day that a violation continues constitutes a separate violation. However, a person shall be exempt from the fines levied under this subsection (b) if:

(1) The person has not previously been found civilly or criminally liable for a violation of this section; and

(2) Upon receipt of a notice of a violation of this chapter, the person immediately ceased the activity described in the notice and diligently attempts to obtain the necessary approval or permit or correct the cause of the violation.

(c) In addition to the fines imposed under subsections (a) and (b) of this section, the City shall assess a fine against the responsible party equal to all costs incurred by the City in restoring the public place or public property to its condition prior to the unauthorized use.
