(a) A prospective retail vendor of salable fireworks may apply to the City for a permit. The City retains discretion over permit issuance, and shall only issue a permit under the following terms and conditions:

(1) The prospective retail vendor completes and submits an application for retail sale of fireworks permit to the City.

(2) Proof of existing fireworks permit by the State of Alaska and continued compliance with the terms of the State permit.

(3) Payment of a $500.00 permit fee every two years.

(4) Registration for the collection and payment of sales tax as required by Chapter 4.25 CCO.

(5) Periods of sale are limited to June 20th through July 7th, December 15th through December 31st, and January 1st through January 14th.

(6) Retail vendors must comply with all applicable laws, including but not limited to applicable State and local Fire Safety Codes.

(7) The City reserves the right to immediately suspend any permit issued pending investigation of a suspected violation of this chapter or other law, or to prevent the continuation of unreasonably hazardous or nuisance-inducing activity. The City reserves the right to impose any conditions on any permit reasonably necessary to eliminate or reduce occurrence of hazards and nuisances. Following completion of any investigation, the City shall promptly notify the permit holder whether the permit is being reinstated, reinstated subject to conditions, or revoked.

(8) A permit issued under authority of this section is nontransferable.

(9) A permit issued under authority of this section shall only be valid for one calendar year, expiring on December 31st of the applicable year. [Ord. 18-01 § 2 (Att.), 2018. Code 1979 § 08.17.03.]
