The following definitions shall be used in this chapter:

Comprehensive plan” means the document titled “Ataqan Akun Community Plan” adopted on March 16, 1995, by the Council pursuant to Ordinance 95-04, and all amendments, revisions and rewrites thereto.

Notice of potential violation” means a notice issued by the Zoning Administrator ordering a property owner to immediately stop all activity based on a violation or perceived violation of this Code of Ordinances.

Person” means any individual, partnership, association, and corporation whether acting on their own behalf or as an agent, consultant, contractor, or employee of another, but does not include the City, its employees when acting on behalf of the City, or persons directly contracting with the City.

Public place” means any public right-of-way, easement, or dedicated area for any street, road, alley, pathway or area for public use arising from dedication, prescription, contract or equity within the boundaries of the City and further includes property leased to the City and property identified for transfer to the City under Section 14(c) of the Alaska Native Claims Settlement Act or which the City has identified as real property to be transferred to the City in the litigation now pending between the Tanadgusix Corporation and the City entitled City of Saint Paul v. Donald Evans, U.S. District Court for the District of Alaska, Case No. 3:97-ev-0181-HRH.

Schedule of fees and penalties” means the schedule of fees and penalties adopted under CCO 18.05.060, as the same may be amended from time to time.

Use” means (1) occupation of a parcel of land, (2) construction on a parcel of land, (3) placement of any temporary or permanent structure or equipment on a parcel of land, (4) operation of construction and heavy equipment including dump trucks, graders, backhoes, and other equipment in a public place, (5) causing delay or obstruction of normal traffic flow, (6) excavation on parcel of land, (7) alteration of the grade of a parcel of land, or (8) alteration or disturbance of any signs, fill, pavement, or other public improvements. Mere movement of a single piece of construction equipment across a public place, not more than once daily, shall not be considered as use of the public place unless there is clear threat of danger to public property or harm to the public as determined by the City Manager.

Utilities” means water, sewer, electric, telephone, cable and similar services provided in the community.

Zoning Administrator” shall have the meaning set forth in Chapter 18.05 CCO. [Code 1979 § 13.01.010.]
