For purposes of this chapter, the following definitions apply:

Enterprise property” shall mean all real property, personal property and intangibles used in the operation of a revenue producing activity regardless of whether the activity is operated on an income generating, break-even or net loss basis.

Intangibles” shall mean all intangible assets, rights and claims of the City of Saint Paul of every kind and nature relating to an enterprise, including licenses, authorizing certificates, customer lists, telephone numbers, advertising and marketing programs and plans, websites, referral relationships, business information, the trademarks, and trade names associated with an enterprise, and associated goodwill, and software owned by the City of Saint Paul including any enhancements, upgrades and improvements thereto authored by employees of the City of Saint Paul and used exclusively in the operation of an enterprise.

Local proposer” means a person or entity who (1) holds a current Alaska business license, (2) holds all other current State of Alaska registrations required for the nature of the business and the form of the entity, (3) has continuously maintained a physical place of business within the State of Alaska for a period of one year immediately preceding the date of proposal opening, and (4) if a joint venture, is composed entirely of venturers who qualify under subsections (1) through (3) of this definition.

Personal property” shall mean supplies, equipment, vehicles, materials, goods, inventory, books, records and the like.

Property” shall mean real property, personal property, and intangibles.

Real property” shall mean any estate or interest in land and any structure or improvements, including fixtures, permanently affixed to land. [Code 1979 § 6.07.010.]
