(a) It is unlawful for any person to operate a motorized vehicle in violation of Alaska State law.

(b) It is unlawful for any person to operate a recreational vehicle except as follows:

(1) Persons 12 years of age and younger may operate a recreational vehicle if:

(i) A parent or guardian is on the recreational vehicle with them.

(2) Persons ages 13 to 14 may operate a recreational vehicle if:

(i) Under constant close supervision of a parent or guardian.

(3) Persons ages 14 to 16 must have an active instructional permit issued by the State of Alaska to operate a recreational vehicle.

(4) Persons over 16 but under 18 must have an active provisional license issued by the State of Alaska to operate a recreational vehicle.

(5) Persons over 18 must have an active license to operate a recreational vehicle.

(6) Persons under the age of 18 must have completed an online recreational vehicle safety course.

(c) Persons under the age of 15 operating a recreational vehicle shall not carry passengers.

(d) All operators of a recreational vehicle and any passenger under the age of 18 shall wear a helmet when on a recreational vehicle. All helmets must contain a manufacturer certification that it meets the standards of the American National Standards Institute, American Society for Testing and Materials or the United States Consumer Products Safety Commission.

(e) Operators of motorized and recreational vehicles shall abide by curfew laws of the City of Saint Paul, as outlined in CCO 9.05.110

(f) It is unlawful for any person to drive, operate, stop or move a motorized or recreational vehicle:

(1) In a careless, reckless or negligent manner so as to endanger the person or property of another, or to cause injury or damage to such person or property;

(2) While under the influence of an alcoholic beverage, intoxicating liquor, inhalant, or any controlled substance, singly or in combination;

(3) In any manner that is a violation of State law;

(4) By overtaking an emergency vehicle, when an emergency vehicle is responding to an emergency call.

(g) Use of motorized vehicles off established roadways and driveways in the Townsite is unlawful except as authorized by state law and regulations and regulations promulgated by the City Council and kept on record at the City office.

(h) Use of motorized vehicles and recreational vehicles on pedestrian trails and paths is unlawful. Recreational vehicles may use City roadways, but must abide by all traffic laws, including but not limited to speed limits.

(i) It is unlawful for a parent, guardian, or other person having the custody or control of a child under the age of 18 to knowingly permit such child to act contrary to the provisions of this chapter. [Ord. 21-05 § 2 (Att.), 2021.]
