(a) Any person acting in violation of this chapter is, upon conviction, guilty of a Level I City offense and is punishable as set forth in CCO 9.05.020.

(b) Upon issuance of a citation for violation of any section in this chapter, any motorized vehicle or recreational vehicle involved in the violation may be impounded. Any impoundment of a motorized vehicle or recreational vehicle will result in an impoundment hearing in the State courts of the State of Alaska, to be held within two business days of impoundment. If necessary for evidentiary purposes, the vehicle may be impounded until the termination of judicial proceedings on the matter. If said judicial proceedings do not terminate within 30 days, the vehicle shall be returned to the rightful owner, provided impoundment fees are paid.

(c) The City’s Department of Public Safety may issue a citation to Saint Paul Island Tribal Court for Civil Mischief for members of the Aleut Community of Saint Paul Island under this chapter. [Ord. 21-05 § 2 (Att.), 2021.]
