Accessory use or structure” means a use or structure on the same lot with, and customarily incidental and subordinate to, the principal use or building.

Commission” means the Planning and Zoning Commission established pursuant to Chapter 18.10 CCO.

Comprehensive plan” means the document titled “Ataqan Akun Community Plan” adopted on March 16, 1995, by the Council pursuant to Ordinance 95-04, and all amendments, revisions and rewrites thereto.

Cottage use” means an activity customarily conducted within a dwelling by the occupants, which use is clearly incidental and secondary to the use for dwelling purposes and does not significantly change the character or appearance of the dwelling or other structures located on the property.

Duplex” means a residential family dwelling intended for occupancy by two families.

Multifamily dwelling” means a residential family dwelling intended for occupancy by more than two families.

Public facilities” means public improvements and structures owned and/or operated by the City at least some portion of which are open to the public for its use and enjoyment.

Real property” shall mean any estate or interest in land or in any structure or improvements, including fixtures, permanently affixed to land.

Residential dwelling” means a residential family dwelling intended for occupancy by people, regardless of whether occupied by one family unit (such as a single-family dwelling), two families (such as a duplex) or multiple families (such as an apartment building).

Schedule of fees and penalties” means the schedule of fees and penalties adopted under CCO 18.05.060, as the same may be amended from time to time.

Shoreline” means (1) in the Village Cove Harbor area, the uplands-tidelands boundary as defined in Section 5 of the Agreement for the Small Boat Harbor Project – Saint Paul Island, Alaska, between Tanadgusix Corporation, the City of Saint Paul, and the Aleut Community of Saint Paul Island, effective October 31, 2007, and approved by the United States District Court for the District of Alaska on June 20, 2008, in that certain Partial Final Consent Judgment Adopting the Agreement for Small Boat Harbor Project, Case No. 3:97-cv-0181-HRH; and (2) on the remaining portions of St. Paul Island, the mean high water line, determined as the average of two consecutive high tides, creating the boundary between uplands and tidelands, as the same may fluctuate due to erosion, accretion or reliction.

Structure” means anything that is constructed or erected and located on or under the ground or attached to something fixed to the ground.

Subsistence use” means an activity traditionally conducted by Alaska Natives for gathering and harvesting of food, fuel, recreational, or cultural use when performed in a manner that is intended to be harmonious with the survival and continued existence of plants, animals, birds, fish and other non homo sapiens elements of St. Paul Island.

Variance” means a variation or modification of the requirements of Chapter 18.15 CCO, Land Use Permits and Construction Standards, or this chapter and Chapters 18.25 and 18.30 CCO, Zoning, under the provisions of CCO 18.30.030.

Zoning Administrator” means the person designated by the City Manager to perform the duties of such position as identified herein. The City Manager may (1) designate him- or herself to serve in this role, (2) designate another City employee with appropriate knowledge and background in public land use or (3) retain a third party to perform such duties.

Zoning map” means the City of Saint Paul Interim Zoning Map dated June 1996, and all amendments and revisions thereto. [Code 1979 § 15.01.010.]
