(a) Before occupying or using a new structure, the owner or other person with an interest in such new structure shall obtain an occupancy approval from the Zoning Administrator. The occupancy approval shall be issued upon the Zoning Administrator’s: (1) receipt of a notice from the holder of the notice to proceed that the activity authorized by that notice to proceed has been completed, (2) receipt of a certification from the contractor that the structure complies with CCO 18.15.110 and all setback requirements, (3) receipt of approval from all utilities serving the structure, (4) receipt of the fee set forth in the schedule of fees and penalties adopted under CCO 18.05.060, and (5) determination by written finding that the structure or project as completed complies with all applicable City ordinances and other applicable State and Federal law.

(b) Occupancy or use by any party prior to receipt of an occupancy approval is a violation of this chapter, and the Zoning Administrator may assess a fine against the owner and/or agent in an amount equal to up to five times the permit cost for each violation. In addition, each day that a violation continues constitutes a separate violation. [Code 1979 § 13.03.020.]
