A person may appeal the Zoning Administrator’s (a) refusal to issue a notice to proceed, (b) issuance of a notice of potential violation, or (c) refusal to issue an occupancy approval to the Council. The Council shall hear the appeal and decide the matter solely on the basis of the City’s record, a written brief and oral testimony from the person who was denied a notice to proceed or occupancy approval or received the notice of potential violation, and a written brief and oral or written testimony of the Zoning Administrator and/or other City department representative.
