Article IV. Variances, Appeals and Violations

(a) A variance from the requirements of this chapter may be granted only if the Zoning Administrator finds all of the following conditions to be true:

(1) The granting of the variance from platting requirements will not be detrimental to the public health, safety or welfare, nor injurious to adjacent property; and

(2) The tract to be subdivided is of such unusual size and/or shape or topographical conditions that the strict application of the requirements of this chapter would impose an economic hardship on the property owner.

(b) A request for a variance shall be submitted when the application for a preliminary plat is submitted under CCO 18.20.090. The request must identify the exact requirements for which the applicant seeks a variance and explain why the variance meets the requirements of subsection (a) of this section.
