(a) After the preapplication meeting, an applicant shall submit four copies of a preliminary plat meeting the specifications set forth in CCO 18.20.140 and the subdivision design standards set forth in CCO 18.20.160 along with the fee set forth in the schedule of fees.

(b) The Zoning Administrator shall review the application for completeness. An incomplete application shall be returned to the applicant with written comments identifying the missing item(s). If the application is complete, the City Clerk shall schedule a public hearing on a date which is not less than 10 days or more than 30 days after receipt of the required materials.

(c) The Zoning Administrator shall review the preliminary plat, other materials submitted therewith, and all written comments submitted by the public or City employees. In addition, the Planning and Zoning Commission shall conduct a public hearing.

(d) At the conclusion of the public hearing, the Planning and Zoning Commission shall decide to approve or disapprove the preliminary plat or may take the matter under advisement for a period not to exceed 60 days. Approval of a preliminary plat may set forth conditions for approval of a final plat including but not limited to requiring the applicant to construct or pay for public improvements that the Planning and Zoning Commission determines are necessary or desirable for the proposed subdivision.

(e) The Planning and Zoning Commission’s decision to approve or disapprove the preliminary plat shall be communicated to the applicant in writing not more than seven days after the decision is made.

(1) If the preliminary plat was disapproved, the Planning and Zoning Commission’s written decision shall include the reasons for the disapproval.

(2) An approved preliminary plat does not constitute approval and/or acceptance of the subdivision or final plat but is deemed to be only an authorization to proceed, after the expiration of the appeal period set forth in CCO 18.10.080, with construction of required improvements, installation of monuments meeting the specifications set forth in CCO 18.20.120 by a surveyor licensed to practice in Alaska, and the preparation of the final plat meeting the specifications set forth in CCO 18.20.150 and the design standards set forth in CCO 18.20.160.

(f) Approval of a preliminary plat shall be effective for a period determined by the Planning and Zoning Commission but in no event will such approval period exceed two years, including extensions. If the final plat is not submitted for approval before the expiration of the approval period, as may be extended, the applicant must submit a new application for preliminary plat approval and a new application fee.
