A. OVERVIEW

1. Description and Purpose This policy establishes policies and procedures for court leave for the City of Saint Paul (City).

2. Applicability This policy applies to all employees of the City.

3. Failure to Comply Failure to comply with this policy may result in disciplinary action in accordance with any and all disciplinary policies of the City or denial of leave.

B. POLICY AND PROCEDURE

1. Leave for Jury Duty

a. Employees shall be granted leave with pay for the time required to attend jury duty that is scheduled during work hours. Time required for jury duty includes actual time spent in commuting.

b. Employees shall be granted up to their normal number of work hours in any one (1) day to attend jury duty.

c. Employees who do not work on a fixed workweek schedule may be granted up to eight (8) hours leave in any one (1) work day.

d. Employees are required to submit written verification of attendance signed by a representative of the court, such as a subpoena or court order.

2. Leave to Appear as a Witness

a. Employees shall be granted time off with pay to appear as a witness or a party before a judicial or administrative body or legislative committee when such appearance is part of the job function.

i. If an employee appears as a witness or a party during his/her normal day off, the employee shall be compensated as provided in the rules governing overtime or holiday compensation.

b. When appearance before a judicial or administrative body is not part of the job function, employees shall be granted time off with pay when summoned as a witness in a proceeding to which he/she is not a named party, and shall be granted time off without pay to appear at a proceeding to which he/she is a party.

i. However, an employee is entitled to time off with pay to attend his/her worker's compensation proceeding.

3. Both annual and sick leave shall accrue to the employees while on court leave.

4. Court leave may be requested by completing a Leave Request using the time keeping system or Leave Request Form, at least three (3) days in advance.

5. Court leave is subject the rules specified in the General Leave Rules Policy Number 04.03.01.
