A. OVERVIEW

1. Description and Purpose This policy establishes policies and procedures for leave without pay for City of Saint Paul (City).

2. Applicability This policy applies to all employees of the City.

3. Failure to Comply Failure to comply with this policy may result in disciplinary action in accordance with any and all disciplinary policies of the City or denial of leave.

B. POLICY AND PROCEDURE

1. Leave Without Pay may be requested in writing using a Leave Request Form at the discretion of the employee’s immediate supervisor when an employee wishes to interrupt service with the City for professional or exceptional personal reasons.

2. Employees may proceed on leave without pay upon receiving approval in writing in advance from the employee’s immediate supervisor, Department Director and City Manager.

3. Eligibility for leave without pay is generally limited to employees who have rendered at least one (1) year of continuous service with the City.

4. Leave without pay may only be granted for up to thirty (30) working days within a calendar year.

5. Leave without pay shall not be granted unless accumulated Annual and Sick Leave is exhausted.

6. An employee is required to return from the leave without pay status on the originally scheduled return date. If the employee is unable to return, he or she must request an extension of the leave in writing. If City declines to extend the leave, the employee must then return to work on the originally scheduled return date or be considered to have voluntarily resigned from his or her employment. Extensions of leave will be considered on a case-by-case basis and shall be approved by the employee’s immediate supervisor, Department Director and City Manager.

7. During the period of leave without pay, employees are not entitled to their wages/salaries or their allowances or benefits, with the exception of medical and life insurance, which remains intact but at the employees’ expense.

8. Leave without pay shall not be deemed to be continuous service for computing termination benefits of employee or accrual of leave days.

9. Leave without pay is subject the rules specified in the General Leave Rules Policy Number 04.03.01.
