A. OVERVIEW

1. Description and Purpose This policy establishes policies and procedures for military leave for the City of Saint Paul (City).

2. Applicability This policy applies to all employees of the City.

3. Failure to Comply Failure to comply with this policy may result in disciplinary action in accordance with any and all disciplinary policies of the City or denial of leave.

B. POLICY AND PROCEDURE

1. Military Leave

a. Regular or probationary employees of the City shall be entitled to Military Leave of absence without pay to serve in the United States Armed Forces, including the National Guard and shall be entitled to reemployment upon their return to the City and ready for work assignment.

b. The employee requesting Military Leave shall provide proof of deployment with the Leave Request Form.

2. Military Leave for Reserve Duty

a. A regular or probationary employee of the City who is a member of a reserve component of the United States Armed Forces, including the National Guard is entitled to leave of absence without pay when ordered to training duty, as distinguished from active duty, with troops or at field exercises or for instruction.

b. The employee requesting Military Leave for Reserve Duty shall provide proof of deployment, training, instruction or other with a Leave Request using the time keeping system or Leave Request Form.

3. Vacancy Created by Military Service Leave

a. The filling of a position made vacant by the granting of a Military Leave of absence of less than six (6) months shall be by temporary appointment. If the period is for more than six (6) months, the vacancy may be by regular appointment.

4. Military leave is subject the rules specified in the General Leave Rules Policy Number 04.03.01.
